Dealing with misconduct

Ten common traps…and how to avoid tripping up!

 29th February 2012

It is essential that organisations manage misconduct issues at an early stage and avoid the many procedural pitfalls that can ultimately lead to successful claims from employees in the Employment Tribunal. This workshop will highlight ten common areas where employers frequently trip up on procedure and offer simple and practical reminders of how to ensure misconduct disciplinaries and dismissals are dealt with as effectively and with the least risk possible.

Common problem areas include:-

  • Suspension, when is it appropriate to suspend and how should employees on suspension be dealt with?
  • Investigation, ensuring a balanced investigation and dealing with problem areas such as witness anonymity requests and on-going police investigations.
  • Communication, ensuring correspondence is clear, managed properly and contains relevant information.
  • Disciplinary hearings, dealing with unexpected issues and repeated postponement requests.
  • Consistency of approach between employees

The above and more issues will be discussed by Paul McGowan, Principal and Liane Atkin, Associate of specialist employment law firm, Collingwood Legal.

Employment Law in relationship to Social Media

27th March 2012

The use of social media and social networking sites is now a fact of life. It can provide real benefits to a business but also carries real reputational risk arising from its use by employees.

Come along to our breakfast seminar for a presentation by Sintons employment team who will look at the pit falls which can arise through the use of social media and provide guidance on how employers need to act in order to protect their interests.

The presentation will include a talk by Helen Kay (Associate), Catherine McNulty (Solicitor) and Donna Hunwick (Solicitor) covering the following topics:

  • The ability of employers to monitor the personal use, by employees, of social media in the workplace and the impact that this will have on human rights and data protection concerns.
  • How to deal with employees using social media outside of the workplace to criticise the employer, to record acts of misbehaviour, or to bully and harass other employees.
  • The importance of having effective policies and procedures in place to deal with the impact of social media in the workplace.

There will also be an interactive session based on cases which the employment team has dealt with over the last year.
